Will of George Lambert Gorwyn
(24 June 1837)

In the Name of God Amen I George Lambert Gorwyn of (Falkedon?) in the parish of Spreyton in the County of Devon, Gentleman do make this my last Will and Testament in manners following (that is to say it is my wish and desire to be buried in the Chuch yard of Spreyton by the side of my late dear wife. I give and  devise unto my son George Lambert Gorwyn for and during the term of his natural life the annual or yearly sum of fifty two pounds of lawful money of Great Britain to be issueing and payable out of and charged upon all that my messuage tenements farm and lands commonly called or known by the name of  Coffins situate in the Parish of Spreyton aforesaid and so direct the said to be paid to him by four equal quarterly payments on the twenty fourth day of  June, the twenty ninth day of September, The twenty fifth day of December and the twenty fifth day of March in every year free  and   of all  for  or on any around whatsoever. The first payment thereof to be made on such of the said days of payment as shall happen next after my death. I also give and devise unto my daughter in law Mary the wife of my said son George Lambert Gorwyn for and during the term of her natural life the annual or yearly sum of twenty six pounds of lawful money of Great Britain to be issuing and payable out of and charged upon all that my messuage and tenement farm and said commonly called or known by the name of Heywood situate in the parish of Hittisleigh in the said County of Devon to be paid to her by four equal quarterly payments on the twenty fourth day of  June, the twenty ninth day of September the twenty fifth day of  December and the twenty fifth day of March in every year first and free of all  for   or on any  amount whatsoever the first payment thereof to be made on such of the said days as shall happen after my decease and I so will order and direct  that for said annual or yearly sums shall be paid into the proper hands of my said daughter in law to and for her own and separate use benefits and disposal  exclusive and independent of the said husband and so as that he may not  or have any thing to do therewith and so that the  same may be subject or liable to his debts   or  and for that pupose I do declare and devise that the  and  of my said daughter in law shall from time to time and at all and at all times notwithstanding       good and sufficient discharge and discharges for the said annual or yearly sum or for so much and such part therof as in such   or  shall be afterwards or  to be or to have    but it is my express will and I do direct that  my said Daughter in Law shall not have any power to sell mortgage alienate  charge or in any way incumber the said annual or yearly sum or any part thereof by way of anticipation or other wise it being my will that the said annual or yearly sum shall remain inalienable and be a permanent provision for her during her life provided and it is my will that in     of the said annual or yearly sums  of fifty two pomds and twenty six pounds or any part thereof  shall be in arrear and unpaid for the space of twenty days use after any or either of the     before appointed for paymnt thereof  and in such  so often as the same may happen it shall and may be lawful to and for the said George Lambert Gorwyn and Mary his wife and I do authoize and empower each of them to enter into and upon the estates farms and lans ot of which their said annual or yearly sums are so respectively made payable as aforsaid or into and upon any part therof and to  for the same or for so much therof as shall be their   and the  and  then and there found to retain and keep until all such arrears and all cost charges damages and expenses attending the taking and helping such  or  shall have been fully paid and satisfied and in default of payment therof o any part therof in due time after such  or  shall be so takn to appraise sell dispose therof or otherwise to act therwith  to law in like manner as in of  taken for     our common . I also give and devise all that my messuage tenment or public house called or known by the name of the Golden Lion Inn situate lying and being in the parish of Cheriton Bishop in the said County of Devon together with the several parts or parts of land orchard and Garden and all other  rights and appurts therto belonging save and except a small archard plot called Strap? Orchard herein after devised unto my housekeeper Elizabetth Langdon her heirs    and assigned for ever to and for  live and their bsolute use and benefit. I also give and devise unto the said Elizabeth Langdon her heirs    and assign all that orchard plot called the Moss  Orchard adjoining the above mentiond  premises called the Golden Lion Inn being part of  certain premises called  tenement also situate in the parish of Cheriton bishop aforsaid to and for the and their absolute use and benefit. I also give  and bequeath unto the said Elizabeth Langdon the sum of two hundred and ten pounds of lawful money of Great Britain. I also give and devise all those my two tenements or  houses orchard garden and premises situate  at or called Hittisleigh well in the parish of Hittisleigh aforsaid now in the possesion of William Pousford and another as tenant therof unto my old servant  now living at Heywood aforsaid and to his heirs and assigns for ever to and for his absolute use and benefit. I also give and bequeath unto the said  the sum of fifty five pounds of lawful money of Great Britain. I also give and devise all those my messuages  farms lands     and premises called or commonly known by the name of  Falkedon  also all my messuage tenement farm or lands called or commonly known by the name of  also all those my messuages tenements farms lands  and premises called or commonly known by the name of Croft and Ringwood or  also all that my said messuage tenement farms lands  and premises called or commonly known by the name of Coffins also all those my tenements or dwelling houses lands and premises called or commonly known by the name of Saint  all situate lying and being in the parish of Spreyton aforsaid Also all other my lands tenements tythes hereditaments and premises whatsoever situate lying and being in the said parish of Spreyton and also all those my mssuages tenements farms lands hereditaments and premises called or commonly known by the name of Westwood Hill and  situate lying and being in the parish of Drewsteignton? In the said County of Devon with all and every the rights  and appurts to the same several hereditaments premises respectively belonging or in anywise apportaining unto William of Westwood in the parsh of Crediton in the county of Devon gentleman and Robert Redland of Crediton in the said County of Devon Gentleman and their heirs. But nevertheless to the uses upon the Trusts and for the intents and purposes and under and subject to the powers provisors    herein after declared and expressed of and concerning  the same (that is to say) to the use of my grandson George Lambert Gorwyn and  his assigns for and during the term of his natural life without impediment of waste and from and after the determination of that estate by any means in his lifetime To the use of the said William  and Robert Redland  and their heirs during the life of my said grandson George Lambert Gorwyn in Trust to support and preserve the contingent  uses and estates herein after limited from being defeated or destroyed and for that purpose to make  and being  as occasion shall require But nevertheless to prevail and suffer my said Grandson George Lambert Gorwyn and his asigns to receive and take the rents and profits of the said messuages tenements  farms lands hereditaments and premises and every of them during his life and from and after the decease of my said Grandson George Lambert Gorwyn there to the use of all and any or such one or more of the children of the body of my said Grandson George Lambert Gorwyn lawfully to be begotten for such estate or estates and in such parts and  manor and farm and subject to such  limitataions and powers as my said Grandson George Lambert Gorwyn by any deed or deeds instrument or instruments in writing or by his last will and testament in writing or any codicil or codicils hereto shall from time to time direct limit appoint give or devise the same or any part thereof and in default of and with any such direction limitation appointment gift or devise or in  anysuch shall be made their subject thereto and when and as the estate or Estates interest or interests therby directed limited given or appointed shall respectively  and  and in the meantime subject thereto and as to such part or parts of the said messuage tenements farms lands tythes houses and premises and all such Estate and interests herein wereof no such direction limitation gift or devise shall be effectually made To the use of the first son of the body of my said grandson George Lambert Gorwyn lawfully to be begotten and the heirs of the body of such first son lawfully issueing and for default of such issue To the use of the  this fourth and all and every other the son and sons of the body of my said Grandson George Lambert Gorwyn lawfully to be begotten severally and in  one after another as they shall be in seniority of age and priority of birth and the heirs of the body and bodies of all and every such son and sons issuing the  of such sons and the heirs of his and the body and bodies being always prefered and to take the younger of such sons and every  daughter and daughters of the body of my said Grandson George Lambert Gorwyn lawfully to be begotten equally to be divided between or }{ amongst them if    share and share alike to take as Tenants in common and the heirs of the body and bodie of all and every such daughter and daughters and in default of lawful issue of any one or more of such daughter or daughters then being more than our  as to the part or share parts or  of such daughter or daughters whose issue shall so fail. To the use of the other or remaining daughters to be divided between them if more than one share and shares alike as tenants in common and the issue of their respective bodies and in case there there shall be but one other remaining daughter then as to the part or share parts or shares of the daughter or daughters so failing of lawful issue. To the use of such only remaining daughter and the issue of her body and in case there shall be but one daughter of the body of my said grandson George Lambert Gorwyn then to the use of such only daughter and the heirs of her body and in default of such issue to the use of my Grandson Richard Lambert Gorwyn and his assigns for & during the term of his natural life without impediment of waste and from and after the declaration of that state by any means in his lifetime then to the use of the said William  and Robert Redland and their heirs during the natural life of my said Grandson Richard Lambert Gorwyn in trust to support and preserve the contingent uses and estates herein after limited from being defeated or destroyed and for that purpose to make  and being  as occasion shall require but nevertheless to permit and suffer my said Grandson Richard Lambert Gorwyn and his assigns for  and take the rents and profits of the said messuages tenements  farms lands hereditaments and premises during his life and from and after his decease To the use of the first son of the body of my said Grandson Richard Lambert Gorwyn lawfully to be begotten and the heirs of the body of such first son lawfully issueing and for default of such issue To him of the second third fourth fifth and all and every othr son and sons of the body of my said Grandson Richard Lambert Gorwyn lawfully to be begotten severally succesively and in remainder one after another as they shall be in seniority of age and priority of birth and the heirs of the body and bodies of all and every such son and sons issuing the  of such sons and the heirs of this and their body and bodies being always prefered and to take before the younger of such sons and the heirs of this and their body and bodies and in default of such issue To the use of all and every the daughter and daughters of the body of my said grandson Richard Lambert Gorwyn lawfully to be begotten equally to be divided between them if more than one share and share alike to take as tenants in common not as joint tenants and the heirs of the body and bodies of all and every such daughter and daughtrs issuing and for for default of lawful issue of any one or more of such daughter or daughters there being more than  our  as to their part or share of such Daughter or Daughters whose issue shall so fail to the use of the other or remaining daugters equally to e divided between them if more than ne share and share alike to take as tenants in common and the heirs of their respective bodies and in case their shall not be but one other or remaining daughter  as to the part or share parts or shares of the daughter or daughters so failing of lawfl issue To the use of such only remaining Daughter and the heirs of her body and in case there shall e but one Daughter of my said Grandson Richard Lambert Gorwyn then to the use of such only daughter and the heirs of her body and in default of such issue To the use of my own right heirs for ever I also give and devise all that my messuage and tenements farm lands  and premises called or commonly known by the name of Graystone [ ] also all that my messuage tenement farm lands  and premises called or commonly known by the name  otherwise  also all that my messuage tenement farm land  and premises called or known by the name (Fursdon)  also all those my messuages tenements farms lands  and premises called or commonly known by the several names  and  also all those or that my undivided parts or shares parts or share of and in all that tenement lands and premises called Knowle  with the lime kilns and buildings therein  all respectvely situate lying and being in the }}{{

The parish of Drewsteignton in the County of Devon Also all those my messuage tenements farms lands  and premises called or commonly known by the name of  otherwise  otherwise Heywood situate lying and being in the parish of Hittisleigh aforesaid also all other my lands  and premises whatsoever situate in the parishes of Drewsteignton and Hittisleigh aforesid not herein before devised and disposed of and also all those my messuages tenements or dwellinghouses called or commonly known by the name of   tenement and also all those parts of all that tenement lands and premises called or commonly known by the name of  tenement not herein before devised also all that plot of orchard called Strap? Orhard part of and belonging to the tenement called the Golden Sun Inn aforesaid and al other my lands hereditaments and premises situate in the parish of Cheriton Bishop in the said County of Devon not herein before given devised and disposed of with there and every of there rights  and appurts unto the said William  and Robert Redland and their heirs But nevertheless to the uses upon the Trusts and for the intents and purposes and under and subject to the powers provisoes conditons and limitations herein after  expressed and  of and concerning the same (that is to say) To the use of my Grandson  Richard Lambert Gorwyn and his assigns for and during the term of his natural life without impediment of waste and from and after the determination of that estate by forfeiture or otherwise in his lifetime then to the use of the said  and Robert Redland and their heirs during the said natural life of my said Grandson Richard Lambert Gorwyn and his assigns to receive and take the rents and profits of the said several messuages tenements farms lands    and premises during the natural life and from and after the decease of my said Grandson Richard Lambert Gorwyn then to the use of all and every or such one or more of the children of my said Grandson Richard Lambert Gorwyn lawfully to be begotten for such estate and estates interest and interests and in such parts shares and proportions measure and form and subject to such charges and payments to any one or more of such children and to such  limitations and powers as my said Grandson Richard Lambert Gorwyn in any deed or deeds instrument or instruments in writing or by the last Will & Testament inworking or any Codicil or Codocils thereto shall from time to time first limit appoint gift or devise the same or any part thereof and for want or in default of and until any such direction limitation appointment gift or devise or in case any such shall be made their subject thereto and when and as the estate or estates interest or interests thereby directed limited given or appointed shall respectively  and determine and in the  subject thereto and as to such part or parts of the said messuages tenements farms lands tythes heredits and premises and all such estates and interest therein whereof no such direction limitation gift or devise shall be effectively made To the use of the first son of the ody of my said Grandson Richard Lambert Gorwyn lawfully to be begotten and the heirs of the body of such first son lawfully issuing and for default of such issue to the use of the second third fourth fifth and all and every other the son and sons of the body of my said Grandson Richard Lambert Gorwyn lawfully to be begotten severally successively and in remainder one after another as they shall severally be in seniority of age and priority of birth and the heirs of the body and bodies of all and every such son and son issuing the issue of such sons and heirs of his and their body and bodies  and in default of such issue To the use of all and every the Daughter and Daughters of the body of my said Grandson Richard Lambert Gorwyn lawfully to be begotten equally to be divided between or amongst them if more than one share and share alike as Tenants in Common and not as joint tenants }}{{ end of first pdf file

said Grandsons George Lambert Gorwyn and Richard Lambert Gorwyn and such other person or persons as for the time being shal be  as aforesaid by indenture or indentues to  and  o grant  or appoint by way of   or lease all or any of the messuages tenements farms lands  premises hereby devised respectively to any perso or persons for any term or number of years not exceding ten years to  and tak effect or possession or withn two years next after th sale of such  and not  and so as by way    have or grant there be reserved and ade payable during the  thereof the best yearly  that can be reasonably gotten for the same premises therein comprised at the time of the granting or making theref respectively without any fair premium or  being paid for granting or making the same and so as in every such     or grant there be contained or proviso or condition of security in case the rent or rents thereby respectively reserved be in arrear and unpaid for the space of thirty days  after the same shall become payable as no issue be allowed to  Waste or be exempted from punishment for permitting Waste snd so as that the issue and issues respectively shall and so execute a counterpart or  or such lease or  and it is my further Will and I so declare and direct that it shall be lawfull to and for my said Grandson Richard Lambert Gorwyn and to and for such other person or persons entitled as aforesaid when and as he or they shall respectively attain the age of twenty one years and also to and for the said  and Robert Redland and the survivor of them and the heirs and assigns of such survivor during the minority of my said Grandson Richard Lambert Gorwyn or of the person or persons  as aforesaid to work or join or  with the other owners of the lime Quarry or the said premises called Knowles in Drewsteington aforsaid in working the same for the same for the sale of Lime in the manner as the same is now worked and carried on or in such other manner as may be deemed most advisable and also to open and work any other quarry for that purpose as often as occasion shall require and from time to time to secure for any Mine or Quarry or any part of my said lands and so dig and work the same or otherwis to grant devise and let the same mines and quarries to any person or persons for that purpose for any term not exceeding seven years so as in every such Grant there be contained the usual Clauses generally inserted in Grants of the same or the like description Provided also and it is my will that it shall and may be lawfull to and for my said Grandsons George Lambert Gorwyn and Richard Lambert Gorwyn and I do hereby authorize and empower each of them respectively  when they shall be of the full age of Twenty one years but not sooner by any deed or deeds instrument or instruments in writing to grant limit or appoint any rent or annual sum to be issuing and payable out of and charged upon all or any of the messuages lands and    devised and limited to him respectively unto and to the use of or in trust for any woman he shall marry or take to Wife and that Either before or after such marriage for and during the natural life for or in lieu of their  and in Bar of dower such rent or annual sum to take effect from the  of such of my said Grandsons as shall grant the same and be payable at or upon such days and times and in such manner as he shall think fit but so as such rent or annual sum of sixty pounds a year (tax free) and also to give and grant to or for such woman and her assigns all powers and  by    and   of the rents and profits of the lands and  chargeable therewith and otherwise for recovering the same when in arrear and for that purpose to grant limit and appoint the same lands and  to any Trustee for any term or number of years to commence from his death and to be determinable upon the death of such woman and payment of all arrears of the said rent or annual sum and al rents and charges  or occasioned by the  or  payment of the sum or  the Trusts of the said }}{{

 or otherwise in  I give devise and bequeth all that my manor or reputed manor of Crediton parts situate lying and being in the parish of Crediton aforesaid and all and every the messuages tenements farms lands  and premises hereto belonging or appertaining and also all such my messuages lands tenements   and premises and all my real estate whatsoever and wheresoever not therein before devised and also all my monies and  for money mortgages in for and for  of years and the lands and  therein  and granted and also all my farming   stock  household goods and furniture and all other my  whatsoever and of what nature or kind soever whensoever the same shall be at the time of my death unto the said William  and Robert Redland their heirs  assigns and assigns upon and for the trusts intents and purposes herein after  of and  the same (that is to say) Upon Trust  they the said  and Robert Redland or the survivor of them or the    or  of such survivor  to and shall as soon as conveniently  may be and as they or he shall  think proper after my decease absolutely sell and dispose of all and singular the said manor or reputed manor messuages lands  tenements real and personal estate and effects and every part therof in such parcels or lots and in such manner and  by public auction or private  as they or he in their or his discretion shall think best and for such  or    or sums of money as  be reasonably gotten for the same and so and shall  and  the same when sold to the urchaser or purchasors thereof his her or their heirs    or assigns or as he or they shall direct or appoint and also so and shall collect get in and receive all debts Sum and sums of money that shall and may be due and owing to me at the time of my decease to the end that the whole of my to this and that the whole ogf my residuary will and personal estate may be converted into money and upon this  trust that they the said  and Robert Redland and the survivor of them and the heirs  and  of such survivor so and shall by with and out of money to arise or be produced by such sale and sales which shall be served by them or him and by with and out of such part of my personal estate as shall consist of money in the first place pay and discharge all my just debts funeral expenses the expenses of proving this my will and thee legacys herein before by me given and all and every the costs charges and expenses that may be incurred in the execution of the trusts of this my will and of carrying the same into effect after full payment thereof upon Trust that they the said  and Robert Redland and the survivor of them and the executors and  of such survivor shall and so stand and be possessed of the residue or surplus of the money then remaining in their or his hand or hands  to any of the purposes aforesaid upon trust for and to pay and divide the same into and equally between my said two Grandsons George Lambert Gorwyn and Richard Lambert Gorwyn  their executors  and assigns share and share alike as Tenants in common and so for and upon as other Trust intent or purpose whatsoever and it is my express will and I do  and  that the receipt and receipts of them the said  and  or either of them or the survivor of them or the heirs    or assigns of such survivor shall be  a good and sufficient discharge and discharges for any purchase money mortgage money or other part of my Estate and effects ewhich in or by such receipt or recits shall be acknowledged or expressed to be or to have been  and that any purchase or purchases motgage or mortgages or other person or persons paying the same and taking such  and  shall not in any moment be liable to see to the  of the same or be answerable or accountable for the  or  thereof or of any part thereof provided always and I do hereby further order  and  that the said  and Robert Redland or either of their his heirs     or assigns shall not be changed or changeable with or for any more or other money then they or he shall respectively actually  or which shall actually  to their or his hands or hand notwithstanding he or they shall or may give or sign or join in giving or signing  receipt or receipts for the sake of  conformity  and that neither of them shall be answerable or }}{{

accountable for the other of them or the   or  of the other of them but will and way of them shall singly and alone be answerable for themself only  and for his  and        and defaults and that they or other of them shall not be answerble or accountable for any banker  or for whomsoever or in whose hands any part of the said Trust names shall be  paid  for deposits of safe custody or otherwise in the  of the trusts of this my will nor for any person or persons acting under or employed by them or him in in the payment management or disposal of the said Trust monies and payments or any part thereof pursuant to the Trust of this my will and that they or other of them shall not be answerable or accountable for the rise or fall in the  or value of stock or the insufficiency in title or value of any security or securities in or upon  the said trust monies or any parts thereof or in the execution of the trusts of this any Will  the same shall happen by or through his or their own wilful neglect or default and then and in that case he and they shall singly and alone be answerable for such his and  their own respective acts rights or defaults and also that it shall be lawful to and for the said William  and Robert Redland their  and advisors and I do hereby authorize and empower them and  of  by and out of the    shall  to their respective hands by virtue of the Trusts aforesaid to  retain reimburse  and pay himself and themselves respectively and also to pay and allow his and their cotrustee all costs charges  and expenses  Fees to Counsel and others for advise which they or  of these shal or may pay  expenses or be put into in the  of the said Trusts or any of them or in    thereto all where some costs  and expenses shall and may be  settled and allowed fully and liberally as between solicitors and client and not as between party and party in any cause or legal proceding and I so hereby appoint the said William  and Robert Redland and the survivor of the Trustees and Trustee for my said Grandsons George Lambert Gorwyn and Richard Lambert Gorwyn and of the estates monies and property hereby divided and bequeathed too or in trust for them or for their benefit respectively until they shall respectively attain the age of 21 years it being my express will that they the said William  and Robert Redland and the survivor of them shall have the sole    and direction of the Estates  and property thereby by the given to them respectively and that no other in person or persons shall interfere or have any    the  during their minority and I so request that they or he will attend to and take care of the same respectively and I do hereby nominate and appoint the said William  and Robert Redland Executors in trust of this my Will and lastly I revoke all  Wills by me at any time hertofore made and declare this to be and  my last Will and Testamant.
