HEATON, George : Will - 14th October 1834.

 

This is the last Will and Testament of one George Heaton of Harwood in the County of Lancaster, Yeoman. First I order and direct all my just debts, funeral expenses and the charges of the Probate and execution of this my Will to be paid and discharged out of my personal Estate. And I give, devise and bequeath the Annual rents, Issues, Interest, Profits and proceeds of all and singular the residue of my personal Estate and of all my real Estate unto my dear wife Rachel for and during the term of her natural life, if she so long continues my Widow to and for her own use and benefit. And from and after the Marriage or death of my said wife, I do hereby give and devise unto my son James Heaton, his Heirs and assigns for ever, all my share and Interest in my freehold Estates con??ously called or Known by the names of Hagscar and Raikes, situate situate in Harwood aforesaid, Together with all the Coal, stone and other minerals lying under the same. Also I give and devise unto my said son James Heaton his heirs and assigns for ever, All my share and interests in the Coal Mines and other minerals lying and being under the Knotts Estate situate in Harwood aforesaid, and all benefits arising therefrom. Also I give and devise unto my son Robert Heaton, his Heirs and assigns forever, all those two Cottages situate in Harwood aforesaid in the respective occupations of Thomas Entwisle the younger and Joseph Riley together with the Bake or Outhouses to the first named Cottage, Together with the shippon and Garden in the Front of the said Cottages. Also I give and devise unto my said son James Heaton, his Heirs and assigns for ever, All those ??? Cottages situate in Harwood aforesaid, in the occupation of Thomas Entwisle the elder and William Carpenter, on Condition that he and they pay unto my Daughter, Mary, during the term of her natural life, the annual rents, Issues and Profits thereof to and for her own use. Also I give and bequeath unto my son Jonathan and his Heirs and assigns for ever, All those two cottages situate in Harwood in the respective occupations of William Smith and John Rammill, or their undertenants together with the Gardens before the same, and also another cottage in the occupation of Robert Clough with the Garden necessary and other premesis attached thereto. Also I give and devise unto my son Thomas, his Heirs and assigns for ever, those two Cottages situate in Harwood aforesaid in the respective occupations of William Horrocks and George Openshaw. Also I give and devise unto my sons Jonathan and Thomas, their Heirs and assigns for ever, share and share alike and to hold as tenants in common, and not as joint tenants, a plot, piece or parcel of Land or Ground lying behind the said last mentioned five Cottages. Also I give and devise unto my said son James Heaton, his Heirs and assigns for ever, one fourth part share of the sum of Fifty pounds, advanced by me upon security of the Tolls arising from the Turnpike Road leading from Bolton to Edenfield: Also I give and bequeath unto my Daughter, Betty, the sum of One hundred pounds to be paid out of my personal Estate within twelve months after the Marriage or decease of my said wife, whichsoever shall first happen. All the rest, residue and remainder of my personal Estate not hereinbefore disposed of I give and bequeath the same unto my said son, James Heaton, absolutely for his own use. And I nominate, constitute and appoint my said Son James Heaton, and my Friend George Ainsworth of Great Bolton, burrier, Executors of this my Will. In witness whereof I have hereunto set my hand and seal, the fourteenth day of October, One thousand eight Hundred and thirty four.
