Notice to the Court of Supplemental Authority

Plaintiffs by counsel respectfully request the Court to take judicial notice of John Doe I, et al. v. Unocal Corp. {356kb.pdf}, Nos. 00-56603, 00-57197, 00-57195, 2002 WL 31063976 (9th Cir. Sept. 18, 2002). This opinion supports propositions set forth in Plaintiffs’ Consolidated Opposition to Defendants’ Motion to Dismiss and Cross-Motion to Strike Certification of Scope of Employment, filed Dec. 17, 2001.

Specifically, the opinion soundly supports Plaintiffs’ arguments that the Alien Torts Claims Act, 28 U.S.C. § 1350 (“ATCA”), provides jurisdiction and a cause of action for claims that constitute violations of jus cogens norms, and that torture and murder are violations of jus cogens norms. (Pls.’ Consolidated Opp’n to Defs.’ Mot. to Dismiss and Cross-Mot. to Strike Certification of Scope of Employment at 24.) The court in Unocal affirms that “[o]ne threshold question in any ATCA case is whether the alleged tort is a violation of the law of nations” and that “torture, murder, and slavery are jus cogens violations and, thus, violations of the law of nations.” Unocal {356kb.pdf}, 2002 WL 31063976 at 8.
