“ On April 21, 2006, the D.C. Circuit issued its opinion in Bancoult v. McNamara, 445 F.3d 427 {justia, altlaw, 147kb.pdf, copy} (D.C. Cir. 2006), which thoroughly discusses the political question doctrine and its application in matters involving the national security and foreign affairs. The court held that the doctrine barred a suit which alleged that the United States forcibly removed plaintiffs from their homes on the island Diego Garcia in order to construct a naval base. The Bancoult opinion is pertinent to the argument raised in the United States’ Mem. in Opposition to Plaintiffs’ Motion to Alter Judgment (filed December 21, 2005) at 9-10 and 13-14, that this suit is barred by the political question doctrine.”
