Motion to Dismiss Based upon Selective Prosecution

Now comes the defendant, Brett Bursey, and moves this Court to dismiss the Information against him. The Information should be dismissed because this prosecution is based upon his exercise of protected First Amendment free speech rights critical of the President of the United States; further, others present in alleged “restricted zone” were not arrested or charged with any criminal offense.

Defendant requests that this motion be heard at the close of all evidence presented at the trial of the case.

The Court is asked to consider in support of this motion:

1)  the facts as found by the court at the conclusion of all {p.2} evidence presented at trial;

2)  all Exhibits (#1-6) presented by the defendant at the Pre-Trial Conference/Hearing held on August 27, 2003;

3)  the attached Civil Complaint filed on September 23, 2003 in the United States District Court for the Eastern District of Pennsylvania bearing Civil Action No. 03-4312 (attachment #1);

4)  such other evidence and exhibits as may be later submitted in support of the motion.
