Pursuant to Rule 12(b)(1) of the Federal Rules of Civil Procedure, defendant, the City of Philadelphia, by its undersigned counsel, hereby moves this Court to dismiss this action for lack of subject matter jurisdiction. In support of this Motion, the City relies upon the Memorandum of Law in Support of the Motion to Dismiss of Defendant United States Secret Service (Document #16, Attachment #1).
