Spent Convictions

 

What is a Spent conviction ?

Having a spent conviction means that you have completed a period of rehabilitation for a conviction without re-offending and you do not have to disclose this conviction with job applications, unless the vacancy is excepted under The Rehabilitation of Offenders Act 1974.

Does a spent conviction remain on my record ?

Minor convictions may be wiped off the PNC ( police national computer ) after about 20 years.

The PNC record is kept for life if you have been given a custodial sentence of 6 months or more, or if you have been convicted of sexual crimes, violence or serious drug offences.

Cautions.

A caution is not a criminal conviction. Therefore if a job applicant is asked about any convictions, cautions do not have to be disclosed. However, if you are applying for any excepted positions any Enhanced Disclosures will reveal all convictions, warnings, reprimands and cautions.
