| Please read the entire agreement. The agreement
ends with the text "END OF AGREEMENT"
GUARANTEE: You are guaranteed that we will
send the number of visitors to the URL you specify
within 7 days, 30 days of our receipt of your
payment, as specified in your order. Some orders
may be specified as "open ended" in
which case you are guaranteed to receive 100%
of the traffic you order, but no time limit
is specified. An additional fee applies for
48 hour or 7 day delivery.
REFUNDS: If we do not deliver the number of
visitors promised within the guaranteed amount
of time, you may claim a refund. Upon verification
of your claim, we will provide a refund of your
entire purchase price on a pro-rata basis. When
making a refund claim, you must provide us with
complete RAW server logs, including referrer
logs, error logs and access logs from the site
and time period in question via download or
email as a ZIP file (server logs are the only
reliable method of counting a user). Stats,
data and other information from third party
counters (e.g. Extreme-DM.com, hitbox) and/or
compiled statistics are not sufficient to establish
a claim. In the event that a campaign is not
delivered by the due date, it shall be automatically
extended until one of the following occurs (1)
the campaign is completed.
POPUP RESTRICTIONS:
The popup restrictions differ based on the type
of traffic you order. In all cases, any new
window generated by your URL shall be considered
a popup window, including dialog boxes and new
browser windows.
DEDICATED TRAFFIC: Ordering DEDICATED TRAFFIC
removes restrictions on the number of popup
windows that may be included on a campaign URL.
Content on URLs served by dedicated traffic
must still be acceptable (see the section "UNACCEPTABLE
CONTENT").
TARGETED TRAFFIC: We cannot deliver TARGETED
VISITORS to sites with ANY POPUP WINDOWS. Please
do not order geotargeted traffic for URLs with
popup windows. For example, "ENGLISH ONLY"
, "US/CAN ONLY" and "UK"
traffic CAN NOT BE SENT TO URLs WITH ANY POPUPS.
Very important: If your campaign is found to
be violating this policy, one of the following
may occur (1) the campaign will be suspended
or (2) In lieu of suspending the campaign, it
may be downgraded to a type of traffic that
allows pop windows (e.g. by changing "US/Canada"
target to "NORMAL"). In either case,
you will not be entitled to any refund.
NORMAL TRAFFIC: NORMAL TRAFFIC cannot be delivered
to sites with more than one popup window. A
URL with embedded sounds may not include a popup
window.
Any popup window spawned by your site
(A) must not spawn additional popup windows
(B) must not include embedded sounds
(C) must appear entirely onscreen
(D) must not open a URL for a service that pays
for popups or traffic (for example: Focalex,
Fastclick, Internet Fuel, Popup Traffic)
(E) the standard close button must not be disabled
or hidden and,
(F) must only be generated using a JavaScript
'open' function.
NO POPUP TRAFFIC: Certain campaigns are specified
as 'no popup' campaigns. Geotargeted traffic
is always no popup traffic, other types of traffic
may be specified as no popup traffic as well.
URLs served by no popup campaigns may not generate
any additional windows (for example, the URL
cannot use javascript alert, open or confirm
functions). No popup campaigns may not generate
any sounds.
Very important: If your campaign is found to
be violating this policy, it will be suspended
and you will not be entitled to any refund.
UNACCEPTABLE CONTENT:
We cannot deliver traffic to URLs that perform
any of the following actions:
(1) attempt to automatically install software
or ACTIVEX controls (2) generate JavaScript
errors (3) spawn signed Java applets (4) automatically
display javascript confirm dialogs (5) automatically
display javascript alert dialogs (6) automatically
move, resize or change the focus of the main
browser window (7) automatically submit email
based forms (8) attempt to change any user settings,
including but not limited to attempting to change
the user's homepage or attempting to add to
the user's favorites (9) cause virus scanners
to generate a warning or (10) load URLS in a
way that is not visible to users.
Very important: If your campaign is found to
be violating this policy, it will be suspended
and you will not be entitled to any refund.
TRAFFIC SOURCES AND TYPE:
The source of traffic may change at any time.
For example, your campaign may be delivered
using full screen redirects, click through traffic,
"404 pages", popups/popunders, expired
domain names or other traffic sources or some
combination of traffic sources. You are guaranteed
that your URL is loaded in a way that is visible
to the visitors
RIGHT TO REFUSE SERVICE:
We reserve the right to deny service to any
individual or URL at our discretion. A pro-rata
refund will be provided if service is denied
after a campaign has started (except as outlined
above).
ABANDONED CAMPAIGNS:
Campaigns that remain paused or suspended for
over 60 days will be considered abandoned and
may be terminated. Such campaigns are non-refundable.
LIMITATIONS: IN NO EVENT SHALL MARKETINGTROLL,TRAFFICTROLL
OR ANY OF OUR COMPANIES BE LIABLE TO YOU OR
ANY THIRD PARTY FOR SPECIAL, INDIRECT, INCIDENTAL
OR CONSEQUENTIAL DAMAGES WHETHER ARISING UNDER
CONTRACT, WARRANTY, OR TORT (INCLUDING NEGLIGENCE
OR STRICT LIABILITY) OR ANY OTHER THEORY OF
LIABILITY. MARKETINGTROLL,TRAFFICTROLL OR ANY
OF OUR COMPANIES LIABILITY FOR DAMAGES, REGARDLESS
OF THE FORM OF THE ACTION, SHALL NOT EXCEED
THE FEE PAID BY YOU FOR THE SERVICES. We cannot
be held responsible for factors beyond our control
that may interfere with our ability to deliver
visitors to your URL. Such factors include,
but are not limited to: downtime on your server,
overuse of your bandwidth quota (if applicable),
errors on your site and network outages beyond
our servers.
TERMINOLOGY: (1) In the present context, a
visit generally occurs when a HTML file is loaded
from your server. A hit occurs when a file is
loaded from your web server. Since loading a
single web page can cause several files to load
(e.g. images), several hits usually occur when
a page is loaded. Thus, the number of hits is
always greater than (or equal to) the number
of visits. The term number of visitors
is interchangeable with the term number
of visits. Several visits
may originate from a single IP address or individual.
This generally occurs when an individual returns
to or reloads a webpage. (2) Pro-rata
refunds are calculated by dividing the number
of visits we delivered AT THE TIME THE REFUND
WAS CLAIMED by the number of visits you ordered.
The result of this calculation is subtracted
from 1 and the resulting figure is multiplied
by your purchase price to derive the pro-rata
refund.
