Booking Conditions

1. CONTRACT DEFINITIONS, VALIDITY AND JURISDICTION

Definitions

Throughout this document the following terms are used:

'You' means the 'Party Leader' as identified on the booking form and all members of the party.
'Us' and 'we' and 'our' mean the owners of the property.

Validity

In signing the booking form, the Party Leader signifies that all members of the party agree to be bound by these booking conditions and have given their permission for the Party Leader to make such a declaration on their behalf.

The contract will be valid when:

" The booking form has been completed, signed and dated by you, and received by us.
" We have received the holding deposit, or full payment where the booking is less than 2 calendar months before the rental period begins.
" We have confirmed the booking to you in writing.

Jurisdiction

This contract is subject to and shall be construed in accordance with English Law and the parties hereby submit to the exclusive jurisdiction of the English Courts.


2. BOOKING, HOLDING DEPOSIT AND PAYMENT

You are responsible to us for all payments in respect of the booking. Reservations will be made definite upon payment of a deposit of £150 per booking. If the rental period is less than 1 week, the deposit will be £150. We must receive the deposit within 7 calendar days of the provisional booking, or the option may be released.

The holding deposit is not refundable.

The balance of the total amount due is payable no later than 2 calendar months before the start of the rental period. Should payment not be received by the due date, we reserve the right to cancel the booking. You may then be liable to pay cancellation charges as set out on the scale in section 5, below.

Full payment at the time of reservation is required for all bookings made within 2 calendar months of the start of the rental period.


3. SECURITY DEPOSIT

You must pay a security deposit of £200 along with the balance due 2 calendar months before the start of the rental. This will be returned in full no later than 30 days after the end of the rental period, provided that the Management Company has confirmed that the property and contents are in order, no excess cleaning is required, and the keys have been returned. Where repair, replacement or excess cleaning is required, a deduction will be made from the security deposit to cover the extra costs incurred. Where this is necessary, we will supply an itemised statement to you along with a cheque for the balance of the security deposit.

Where repair and replacement costs exceed the amount of the security deposit, we reserve the right to pursue recompense from you through court action.


4. AMENDMENTS TO BOOKING DETAILS

a) Changes by you

If you wish to amend any details after we have confirmed your booking, we will do all we can to accommodate the change(s), but cannot guarantee to be able to do so. Some alterations may incur an administration cost. Some alterations within 2 calendar months of the start of the rental period may be treated as a cancellation and you may then be liable to pay cancellation charges as set out in the scale in section 5, below.

b) Changes by us

We will do all within our control to avoid making any changes. In the unlikely event that we must do so because of circumstances beyond our control, we will notify you in writing without delay and where possible make alternative arrangements. Where such arrangements are not acceptable to you, you must notify us in writing. Once we receive your notice we will refund in full all money paid.


5. CANCELLATION

a) Cancellation by you

You must notify us in writing of your wish to cancel. The date of cancellation will be taken to be the date of receipt of your notice. The cancellation charge will be calculated on the total rental cost, including options, according to the following scale. We will return your security deposit in full.

b) Cancellation by us

We will do all within our control to avoid cancellation. If we must cancel your rental because of circumstances beyond our control, we will notify you in writing without delay and where possible make alternative arrangements. Where such arrangements are not acceptable to you, you must notify us in writing. Once we receive your notice we will refund in full all money paid.

6. COMPLAINTS

We will give you full contact details for our Management Company representative before your departure. We hope we will never give you cause for complaint. However, if you experience any problems, wish to register a complaint or raise any concerns regarding the property, you must contact them immediately. Any issue that cannot be resolved to your satisfaction must be notified to us in writing and received within 42 days of the end of the rental period. We can accept no liability for complaints made after that date.


7. FORCE MAJEURE

Without any restrictions to any other booking condition, neither we nor our Management Company shall be liable for any loss, damage or injury arising in connection with your stay at the property, caused by any matter outside of any reasonable control, including (but not limited to) acts of God, war or threat of war, terrorist activity, civil disturbance, strikes or other industrial actions, airport closures, epidemics, acts of governments including quarantines, weather conditions or any event beyond our control.


8. INSURANCE

Insurance is essential - never travel without it. Although every effort is made to ensure the villa is in perfect condition for your holiday, we are not responsible for any deaths, injuries or illness, or loss or damage to property, including motor vehicles, or to that of any guest, however caused, nor for any expenses incurred for any reason.

YOU AND YOUR PARTY ARE STRONGLY ADVISED TO OBTAIN THE BENEFIT OF FULL APPROPRIATE INSURANCE COVER FOR THE DURATION OF YOUR STAY.


9. PROPERTY MANAGEMENT

Our Management Company in Florida is responsible for the maintenance and care of the property that is the subject of this agreement. Access must be granted to them and to bona-fide contractors at all reasonable times, to allow the urgent maintenance and repairs where necessary. Where a contractor needs access, our Management Company representative will be in attendance.


10. PASSPORTS AND VISAS

For entry into the USA, all members of your party who are UK citizens must have a full British passport, valid for at least 6 months after the date of our return to the UK. Holders of passports from other countries should check the relevant requirements with their Embassy. In most cases Visas are not now required for holders of full British passports. If in doubt, check with us before you go.


11. DRIVING LICENCE

To hire a car in Florida you must be over 21 years of age (some car hire companies specify a minimum age of 25). You are required by law in Florida to carry your full driving licence with you at all times whilst driving. If you have the new, photocard type of licence, you must carry both the card and the paper part with you.


12. CAR HIRE

Where your car hire has been arranged through us, we act as intermediary between you and the Car Hire Company. Your contract is with the Car Hire Company and you are bound by their terms and conditions.

The Car Hire Company will send you a voucher before departure, which you must present to the Car Hire Company staff at the pickup point in Orlando.

The Car Hire Company will not release any vehicle if you are unable to present the voucher.


13. ARRIVAL AND DEPARTURE

The property will be available from 4 pm on the first day of the rental period. On the last day of the rental period you must vacate the property by 11 am, unless an alternative arrangement has been agreed with us in advance. We will accommodate changes to arrival and departure times where possible, but such agreement may only be possible shortly before the rental period begins.


14. GENERAL SAFETY AND COMFORT

For your party's safety and comfort, and in response to feedback from guests, this property is a smoke-free environment and we ask you to respect this by not smoking in any part of the house or within the pool screen-enclosure. Use of a barbecue or outdoor grill is not permitted on any part of the property, including the pool area and the garden grounds. Please note that it is a violation of Florida Law to use a barbeque or outdoor grill inside a pool enclosure. Pets are not permitted in the property. We ask you to be good neighbours during your stay, and to make every effort to secure the home against damage and theft.

15. POOL SAFETY

Continuous vigilance whilst in the pool area is essential. The property is fitted with the pool safety devices required by the latest changes to Florida Law, which came into effect in January 2002. A mesh fence is provided which is attached to the screen enclosure at one end and the structure of the house at the other. The purpose of the fence is to prevent accidental or unsupervised access to the pool. It provides a barrier between the pool and any door or window that opens onto the pool area. Access to the pool may only be gained through a gate in the fence which must remain fastened at all times when not in use. The fence must remain in place at all times when children are staying in the house.

IT IS YOUR RESPONSIBILITY UNDER FLORIDA LAW TO ENSURE THAT CHILDREN ARE SUPERVISED AT ALL TIMES WHILST IN THE POOL AREA.
