1. The Property located near the village of Sanvensa ("the Property") is offered for holiday rental subject to confirmation by Sandra & Andy Humphrey ("the Owners") to the renter ("the Client") 2. To reserve the property, the Client should complete and sign the booking form and return it together with payment of initial non-refundable deposit (25% of the total cost). Following receipt of the booking form and deposit, the Owners will reply with confirmation. This is the formal acceptance of the booking. 3. The balance of the rent together with the security deposit is required 8 weeks prior to the rental period. If payment is not received by the due date, the Owners reserve the right to give notice in writing that the reservation is cancelled. Reservations made within 8 weeks of the start of the rental period require full payment at the time of booking. 4. A security (damages) deposit of £100 per booking is required in case of, for example, damage to the property or its contents. However, the sum reserved by this clause shall not limit the Client's liability to the Owners. The Owners will refund the balance within a week after the Client's stay on confirmation from the caretaker that all is in order. The £100 refundable security deposit to cover any damage or breakages and in the case where additional cleaning is needed. The total rental includes 3 hours of cleaning after you leave. If the house is left in an exceptionally dirty state requiring more than the 3 hours the cost will be deducted from £100 your deposit. 5. The Client is strongly advised to arrange a comprehensive travel insurance (including cancellation cover) and to have full cover for the party's personal belongings, public liability etc., since these are not covered by the Owner's insurance. 6. Cancellation will result in the loss of your deposit, and if the cancellation is within 8 weeks of the start of your holiday period the balance of your holiday will be due. If the Owners are able to re-let the accommodation your money will be refunded less any re-advertising and administration costs. 7. The rental period shall commence from 4pm Sunday to 12am Sunday. The Owners shall not be obliged to offer the accommodation before the time stated and the Client shall not be entitled to remain in occupation after the time stated. 8. The maximum number to reside in the property must not exceed 6 unless the Owners have given written permission. Any additional person, adult or child, residing in the property without such agreement, will warrant a pro-rata charge. 9. The Client agrees to be a considerate tenant and to take good care of the property and to leave it in a clean and tidy condition at the end of the rental period. Although a final clean is included in our prices, the Owners reserve the right to make retention from the security deposit to cover additional cleaning costs if the Client leaves the property in an unacceptable condition. The Client also agrees not to act in anyway which would cause disturbance to those resident in neighbouring properties. 10. The Client shall report to the Owners (or the caretaker) without delay any defects in the property or breakdown in the equipment, plant, machinery or appliances in the property, garden or swimming pool, and arrangements for repair and /or replacement will be made as soon as possible. 11. The Owners shall not be liable to the Client for any temporary defect or stoppage in the supply or public services to the property, nor for any loss, damage or injury which is the result of adverse weather conditions, riot, war, strikes and other matters beyond the control of the Owner. Nor for any loss, damage or inconvenience caused to or suffered by the Client if the property shall be destroyed or substantially damaged before the start of the rental period and in such event, the Owner shall within 7 days of the notification to the Client, refund to the Client all sums previously paid in respect of the rental period. 12. Under no circumstances shall the Owner's liability to the Client exceed the amount paid to the Owner for the rental period. 13. The use of the accommodation and amenities where offered is entirely at the user's risk and no responsibility can be accepted for injury to a user or visitor and loss or damage to the user's or visitor's belongings. Children must be supervised in and around the pool.( Copy of Health & Saftey Instructions are available at the property) 14. This Contract shall be governed by English law in every particular including formation and interpretation and shall be deemed to have been made in England. Any proceedings arising out of or in connection with the Contract may be brought in any court of competent jurisdiction in England. |
